Murder and manslaughter

The most serious charge there is. These cases are won or lost on preparation that starts at the police station.

What it covers

Murder and attempted murder
Manslaughter: loss of control, diminished responsibility, unlawful act and gross negligence

What is at stake

Murder is tried only in the Crown Court and carries a mandatory life sentence. The judge sets a minimum term, with starting points from 15 years for an adult. Manslaughter and attempted murder carry up to life. In a murder case, only a Crown Court judge can grant bail.

How we defend it

We attend the police station from the first interview, where the account given often shapes the whole trial.
We test intent, self-defence, loss of control and diminished responsibility against the evidence, with psychiatric and forensic experts where needed.
In joint enterprise cases, the prosecution must prove you intended to assist or encourage the offence. Presence is not enough, and we hold the prosecution to that.
We go through the phone, CCTV, cell site and forensic evidence ourselves and instruct leading and junior counsel early.

Fraud and financial crime

Fraud cases are long, document-heavy and often start with a letter inviting you to an interview. Get advice before you reply.

Offences under the Fraud Act 2006 carry up to 10 years. Money laundering carries up to 14. Sentences turn on the amount involved and your role. A restraint order freezing your assets can be made before any charge, and confiscation often follows a conviction.

Drugs offences

From a possession charge in the magistrates’ court to a multi-defendant conspiracy in the Crown Court.

What is at stake

Supplying or importing a Class A drug carries up to life imprisonment. For Class B and C the maximum is 14 years. The sentence depends on the quantity and on whether the court finds your role was leading, significant or lesser. A third Class A trafficking conviction carries a minimum of seven years.

How we defend it

Role decides the sentence. We challenge any attempt to place you higher in the operation than the evidence supports.

What is at stake

A confiscation order is for a sum the court says you gained from crime. In a criminal lifestyle case, the court can assume that everything you received over the previous six years was the proceeds of crime, unless you prove otherwise. If the order is not paid, there is a prison term in default, and the debt remains. Cash of £1,000 or more can be seized and forfeited in the magistrates’ court without any conviction.

How we defend it

We challenge the benefit figure and the assumptions behind it, with a forensic accountant where the sums justify it.
We prove what is actually available to pay, so the order is one you can meet.
We apply to vary restraint orders so you can pay living and legal expenses.
In cash seizure cases, we prepare the evidence showing where the money came from and what it was for.

What is at stake

Robbery and causing grievous bodily harm with intent carry up to life and are tried only in the Crown Court. Unlawful wounding and actual bodily harm carry up to five years. Common assault carries up to six months. A second conviction for carrying a knife brings a minimum sentence for an adult.

Self-defence is a complete defence. We put the evidence of what you faced in front of the court.

Driving offences

Your licence is your job, your family’s transport and your insurance for years to come. Do not reply to the letter until you have spoken to us.

What it covers

Drink and drug driving, and failing to provide a specimen
Dangerous and careless driving
Speeding, mobile phone and no insurance offences
Failing to name the driver
Totting up, exceptional hardship and special reasons
Driving while disqualified, and offences causing death

What is at stake

Drink or drug driving means a ban of at least 12 months, and three years for a second offence within ten years. Dangerous driving carries a mandatory ban and an extended retest. Twelve points within three years means a ban of at least six months unless the court finds exceptional hardship. A new driver who reaches six points in the first two years loses their licence. Causing death by dangerous driving carries up to life.

How we defend it

We check the procedure. Breath, blood and urine cases depend on the police following it exactly.
We find out whether the prosecution can actually prove who was driving.
We prepare exceptional hardship and special reasons properly, with evidence, because the court hears many of them.
Where the evidence allows, we negotiate with the prosecution over the charge, which can change the points and the length of any ban.

Taxi and private hire appeals

When the council takes your badge, it takes your living. You have 21 days to appeal.

What it covers

Refusal to grant or renew a driver’s licence
Suspension and revocation, including with immediate effect
Vehicle and operator licence decisions
Appeals to the magistrates’ court and on to the Crown Court

What is at stake

The council must be satisfied that you are a fit and proper person to hold a licence. If it refuses, suspends or revokes, you can appeal to the magistrates’ court within 21 days of the decision notice. Unless the council revoked with immediate effect on public safety grounds, you can usually keep working until the appeal is decided. If the appeal fails, the council can ask for its costs.

How we defend it

We lodge the appeal in time and tell you plainly whether you can keep driving while it is pending.
We get the council’s file, the complaint and any footage, and test them against its own policy.
We prepare your evidence and references and present the appeal at the hearing.
Where the decision followed an arrest or charge, we deal with the criminal case as well.

Knives, weapons and firearms

Many weapons offences now carry minimum sentences. The detail of where, why and how you had the item decides the outcome.

What it covers

Having a knife or bladed article in public or on school premises

What is at stake

Having a knife or offensive weapon in public carries up to four years. A second conviction, or threatening someone with a blade, brings a minimum of six months for an adult. Possessing a prohibited firearm carries a minimum of five years for an adult, and possessing a firearm with intent to endanger life carries up to life.

How we defend it

We put forward any good reason or lawful authority, such as use for work, a religious reason or part of national costume.
We test whether the item meets the legal definition, and whether you knew you had it and were in a public place.
Where a minimum sentence applies, we argue the exceptional or particular circumstances that allow the court to depart from it.
In firearms cases, we instruct experts on the classification of the weapon.

Young people and the youth court

A young person needs a solicitor who knows the youth justice system and will fight to keep their future open.

An appeal from the magistrates’ court must usually be lodged within 15 business days, and an appeal to the Court of Appeal within 28 days.

Disbursements

Costs paid to others on your behalf, passed on at cost with no mark-up. Most motoring cases have none. Where one is needed, such as a medical or expert report, the cost is agreed with you in writing before we instruct anyone.

Stages and timescales

We review the papers and advise you before the first hearing. A guilty plea is usually dealt with at that hearing. If you plead not guilty, the court sets a trial date, usually several months later, depending on the court’s list.

Rape trial

The client faced four counts of rape within a relationship. He spoke no English, needed an interpreter at every stage and was remanded in custody for the whole of the case.

We prepared his defence vigorously with counsel, on the basis that the allegations were false. When the jury at the first trial was discharged, we fought it all over again. At the six-day retrial he was found not guilty on every count and released with immediate effect.

The client was one of several defendants accused of misusing confidential banking information to move money into personal accounts. The prosecution ran for more than four years and generated a vast volume of digital evidence.

We went through thousands of pages of material and found the needles in the haystack: the inconsistencies at the heart of the prosecution case. Counsel exposed them in cross-examination over a four-week trial. The client was acquitted of every charge.

The complainant alleged that she had been too intoxicated to consent. Several witnesses supported her account, and on paper the prosecution case looked strong.

We tested every part of that evidence and exposed its inconsistencies, flaws and weaknesses in front of the jury. The verdict was unanimous: not guilty on all charges.

The client faced two counts of rape. The prosecution alleged that he had taken advantage of a woman too intoxicated to consent, and relied on CCTV said to show that she could not stand unaided. The allegation hung over him for several years.

His case was that she had consented. Over a seven-day trial, her account was taken apart in cross-examination. The jury found him not guilty.
High-profile service police investigation

A former soldier was interviewed under caution by the Defence Serious Crime Unit in a high-profile investigation. The events behind it received sustained national media coverage. He instructed Faisal after that interview.

From then on, Faisal was his point of contact for as long as he remained under investigation. He advised him at every stage, dealt with the investigators on his behalf and attended the outcome meeting at his side. The Service Prosecuting Authority decided not to direct any charge, and the case ended there.

The client was charged with sexual assault. The case rested on the word of the complainant.

Meticulous preparation uncovered significant inconsistencies in the complainant’s evidence. Detailed cross-examination exposed them and dismantled the complainant’s credibility. The jury’s verdict was unanimous: not guilty.

A case reported across the national media. The client was accused of leading a conspiracy that brought around 180 kilograms of high-purity cocaine through a UK airport over at least five trips, with an estimated street value of more than £14 million. Importing a Class A drug carries a maximum of life imprisonment, and for an operation on this scale the sentencing guidelines allow for 20 years and more.

The evidence was overwhelming. We secured full credit for an early guilty plea and put forward powerful mitigation. The sentence was 13 years and 4 months, a third below the 20 years the client was facing.

A professional whose job depended on a driving licence faced a ban of well over a year. Nobody had seen the client drive, but the client had made admissions in a police interview conducted without a solicitor. The prosecution relied on those admissions and on remarks said to have been made in custody.

Faisal prepared applications to have that evidence excluded. On the day, the police witnesses did not attend, and the prosecution asked for the trial to be adjourned. Faisal opposed it: there was no proper reason for the absence, disclosure had been served late, and a new trial date would be many months away for a client paying privately. The client was charged with driving over the limit on a breath reading taken at the police station. The person who operated the machine did not come to court. Instead, the prosecution sought to prove the reading through a constable who had only watched the procedure, and through a statement served late.

Faisal had already served notice requiring the operator to attend. He argued that the reading could not fairly be admitted without him. The magistrates agreed and excluded it. With no reading, there was no case. The prosecution offered no evidence, the charge was dismissed and the court made a defendant’s costs order.

A self-employed father reached 15 points after a speeding conviction and faced a ban of at least six months. His one-man business could not run without his licence, and his children and his mother depended on him to drive them.

An application on similar grounds had been refused in the same courtroom earlier that morning. The magistrates found exceptional hardship and did not disqualify him. He kept his licence, his business and his family’s transport.

At the police station

I have been arrested. What should I do?

Ask the custody officer for The National Law Firm by name, or ask someone to call our 24-hour line on 0113 320 9695. Do not answer questions about the allegation until you have spoken to us.

Is advice at the police station really free?

Yes. It is free for everyone, whatever you earn, and it is independent of the police. That applies whether you have been arrested or asked to attend voluntarily.

Can I ask for you instead of the duty solicitor?

Yes. Tell the custody officer you want The National Law Firm and your request is passed to us. It costs you nothing.

Will asking for a solicitor make me look guilty?

No. It is your legal right, and the fact that you asked for a solicitor cannot be used against you.

Should I answer police questions?

Take advice before you decide. The right approach depends on what the police say they have, and we find that out before the interview starts.

What is a voluntary interview?

An interview under caution when you have not been arrested. It is just as serious as an interview after arrest, and what you say can be used in court. You have the same right to free legal advice, so do not attend without a solicitor.

What happens while I am in custody?

You are booked in and told your rights. The police may take your fingerprints, photograph and a DNA sample, and they may search you. Any interview is recorded. The police can usually hold you for up to 24 hours before they must charge or release you, or longer for serious offences if that is authorised.

My child has been arrested. Can you help?

Yes. We represent young people at the police station and in the youth court. Call us with their name and the station. Anyone under 18 must have an appropriate adult with them, and advice at the police station is free.

What is an appropriate adult?

Anyone under 18, and adults who may be vulnerable, must have an appropriate adult with them. This is usually a parent, carer, social worker or trained volunteer. Their role is to support you and make sure you understand what is happening. They are not your solicitor.

What can happen after the interview?

You may be released with no further action, released while the police investigate further, released on bail with or without conditions, or charged. If you are charged, you will either be bailed to court or kept in custody for the next court hearing. You may also be offered a caution or another out-of-court outcome. Take advice before you accept one.

In the magistrates’ court

What happens at the first hearing?

The charges are read and you are asked how you plead. If you plead guilty, you may be sentenced that day, or the case may be adjourned for reports. If you plead not guilty, the court sets a trial date. For some offences, the court also decides whether the case stays in the magistrates’ court or goes to the Crown Court.

Do I have to attend court?

Yes, unless the court has excused you. Failing to attend is a separate offence, the court can issue a warrant for your arrest, and a trial can go ahead without you.

Who will hear my case?

Either a District Judge or a bench of two or three magistrates, advised on the law by a legal adviser. There is no jury in the magistrates’ court.

What sentences can the magistrates’ court pass?

Up to 12 months’ imprisonment for a single either-way offence, and generally up to six months for an offence that can only be heard in the magistrates’ court. It can also impose fines, community orders and driving disqualifications. If its powers are not enough, it can send the case to the Crown Court for sentence.

I already have a solicitor. Can I change to you?

Often, yes. If you are paying privately you can move at any time. If you have legal aid, the court has to agree to the transfer and will only do so for a good reason, such as a breakdown in your relationship with your current solicitor. We make that application for you.

In the Crown Court

When does a case go to the Crown Court?

The most serious offences always go to the Crown Court. Offences that can be tried in either court go there if the magistrates decide their powers are not enough, or if you choose trial by jury.

What happens at a Crown Court trial?

A jury of 12 decides whether you are guilty, and a judge decides questions of law and passes sentence if you are convicted. The prosecution calls its evidence first. You can then give evidence and call witnesses.

What is the Plea and Trial Preparation Hearing?

The first main hearing in the Crown Court, usually called the PTPH. You enter your plea, and if you plead not guilty, the judge sets the trial date and a timetable for preparing the case.

What is a defence statement?

A document setting out your defence and the issues you dispute. In the Crown Court it is compulsory and is usually due within 28 days of the prosecution’s initial disclosure. It can affect what further evidence the prosecution must disclose.

What is unused material?

Material the police gathered but the prosecution does not rely on. The prosecution must disclose anything that might undermine its case or help yours, and we push for it.

What is a basis of plea?

A written account of the facts on which you plead guilty, where you accept the offence but not everything the prosecution says. If the difference affects sentence and is disputed, the judge may hear evidence to decide it.

What are special measures?

Arrangements that help vulnerable or intimidated witnesses give their best evidence, such as screens, a live video link or a recorded interview.

What is bad character evidence?

Evidence of previous convictions or other misconduct. It can only be used in limited circumstances set by law, and we can apply to keep it out.

What is committal for sentence?

When the magistrates’ court convicts you but decides its sentencing powers are not enough, it can send the case to the Crown Court to be sentenced there.

Sentence and costs

Do I get credit for pleading guilty?

Yes. Up to one third off the sentence for a guilty plea at the first opportunity, up to one quarter after that, and up to one tenth on the first day of trial.

Can you tell me what sentence I will get?

We cannot give a definite answer without seeing the evidence and your circumstances. Once we have the papers we advise you on the likely sentence under the sentencing guidelines.

What will it cost?

Nothing at the police station. After that it is legal aid if you qualify, or a fixed fee agreed in writing. Fees and funding

What happens next

We acknowledge your complaint within three days and send you a copy of this procedure.
Our Managing Director, Junaid Rehman, reviews your file and speaks to the member of staff who acted for you.
He invites you to a meeting, in person or remotely, within 14 days of our acknowledgement.
Within three days of the meeting, we write to you confirming what was discussed and any solution agreed.
If you would rather not meet, we send you a full written reply within 21 days of our acknowledgement.
If you are still unhappy, a senior member of the firm who was not involved in your case reviews the decision.
We send you our final written position, with reasons, within 14 days of your request for a review.

If we need to change any of these timescales, we will tell you and explain why.

The Legal Ombudsman

If you are not satisfied with our final response, you can complain to the Legal Ombudsman. You must normally do so within six months of our final response, and no more than one year from the date of the act or omission complained of, or from when you should reasonably have known there was cause for complaint.

Faisal learned the magistrates’ court from the inside. Before he defended anyone, he advised the people who decide the cases.

He trained with HM Courts and Tribunals Service as a legal adviser across West and North Yorkshire, and qualified as a solicitor in February 2022, the first of his intake to do so. He advised magistrates on the law, sat with District Judges and dealt with hundreds of motoring cases, including totting up, special reasons and exceptional hardship.

He then moved into criminal defence, first at a Legal 500 firm in West Yorkshire and then in South Yorkshire, where clients in Doncaster and Sheffield still instruct him. He now defends clients across England and Wales with The National Law Firm.

How he works

Thorough preparation, plain advice and a calm manner in court. Faisal tells clients where they stand at each stage and what he thinks will happen next. Because he has sat on the other side of the courtroom, he knows which points a bench will act on and which it will not.

The prosecution was left with no alternative: the case could not continue, and it was withdrawn there and then. No trial was ever listed, and the court made a defendant’s costs order.
